GOVERNING DOCUMENTS

There are four legal documents (governing documents) that are very important to the structure of any Homeowner's Association:

The Articles of Incorporation 

are filed with the Secretary of the State of Illinois and establish the not-for-profit corporation (The Condominium Homes at Wagon Wheel Pass Homeowners Association) as a legal entity.

The Bylaws are a manual of operating procedures and adopted by an Association for the government of its members and the regulation of its affairs. It includes requirements for the Annual Meetings, election of Board Members, Board Meetings, duties of Officers, and many other items pertaining to the actual mechanics of management of the Association’s affairs.  The IL Condominium Act is the basis for the bylaws.

The Declaration of Covenants, Conditions, and Restrictions is similar in function to a municipal charter in that it is “the law of the land.” This document establishes the legal relationship that exists between the Owners and their Association. It also establishes the authority for the Board of Directors (Board) to manage the affairs of the Association.

Policies, Rules and Regulations

The Board has adopted the Association Policies, Rules, and Regulations, which are contained within this document. These serve the purpose of further delineating the rights and responsibilities of Owners as expressed in the Declaration of Covenants, Conditions, and Restrictions and Bylaws.
